WāhiBJJ Terms & Conditions

Agreement
I, {name}, on {sign_date}, agree to the terms and conditions below. I acknowledge that I have enrolled in the health, martial arts, and fitness program offered through WāhiBJJ. I recognize that the program may involve strenuous physical activity, including, but not limited to, muscle strength and endurance training, cardiovascular conditioning, martial arts training, sparring, and other fitness activities.

I affirm that I am in good physical condition and do not suffer from any known medical condition or disability that would prevent or limit my participation. I understand it is my responsibility to seek medical advice before beginning or continuing training. I acknowledge that my enrollment and subsequent participation are entirely voluntary.


1. Participation & Acknowledgement of Risk

  • I understand that martial arts and fitness training involve inherent risks, including but not limited to: heart attacks, muscle strains/tears, broken bones, joint injuries, head or spinal injuries, concussions, heat exhaustion, and in rare cases, death.
  • I voluntarily accept full responsibility for these risks.
  • I hereby release and discharge WāhiBJJ, its instructors, staff, volunteers, and agents from any and all liability, claims, demands, or actions resulting from participation in activities at WāhiBJJ.
  • I understand that Accident Compensation Corporation (ACC) in New Zealand may cover accidental injuries, but WāhiBJJ holds no responsibility beyond what is covered under ACC.

2. Cooling-Off Period

  • You may cancel this contract without penalty within 5 working days after receiving a copy, by providing written notice.
  • We may charge you for:
    • Any days you accessed the club, at the standard daily rate; and
    • Any goods received upon joining.

3. Use of the Club

  • Membership grants access to all scheduled classes, open mats, and general training sessions.
  • Additional services such as seminars, private lessons, competitions, food, and merchandise are charged separately.
  • WāhiBJJ will make reasonable efforts to provide classes as scheduled, but reserves the right to cancel, reschedule, or substitute instructors when necessary.
  • Class availability may vary depending on demand, public holidays, competitions, or unforeseen circumstances.

4. Fees & Payments

  • Fees must be paid via automatic payments or direct debit.
  • You remain liable for payments regardless of attendance.
  • Membership is ongoing unless formally cancelled (see Section 7).
  • Payments will not increase during the minimum term, except if required by law. After that, WāhiBJJ may increase fees with 30 days’ written notice (email/text is sufficient).
  • Missed payments may result in suspension of access until arrears are cleared.
  • Overdue balances incur a $20 administration fee, plus any collection costs.

5. Freezing Membership

  • You may suspend (“freeze”) your membership for up to 4 months in any 12-month period.
  • Minimum freeze period is 4 weeks.
  • A $20 administration fee per freeze month (or part month) applies.
  • If you use the club during a freeze period, payments will automatically resume.

6. Transfers & Non-Use

  • Memberships are non-transferable and cannot be shared.
  • Absence, holidays, or personal circumstances do not relieve you from payment obligations unless a freeze is applied (see Section 5).

7. Termination & Cancellation

  • By You:
    • You may cancel after the minimum term with 20 working days’ notice in writing or in person.
    • Confirmation of cancellation will be sent within 7 days.
  • By Us:
    • WāhiBJJ may terminate membership immediately if you engage in illegal, unsafe, disrespectful, or disruptive behaviour, or if four or more payments are overdue.
    • If terminated for misconduct, no refund will be given.

8. Club Rules & Conduct

  • Members must comply with all Dojo Rules and Code of Conduct (available at reception and on wahibjj.com).
  • Members must:
    • Train in clean and appropriate attire (including rashguards under the gi for women).
    • Maintain good personal hygiene.
    • Respect staff, instructors, and other members.

Photography & Media

Photos and videos may be taken during classes and events at WāhiBJJ for the purposes of documenting training, sharing with members in’ WhatsApp groups, and promoting the academy on social media and other platforms.

  • By attending, you consent to the possibility of appearing in such photos and videos.
  • If you do not wish to appear, you must notify staff before class begins and avoid participating in group photos or videos taken during or after class.
  • WāhiBJJ will take reasonable steps to respect such requests, but it is your responsibility to inform us in advance.

9. Health & Safety

  • You must immediately report any injury, accident, or unsafe condition to staff.
  • You must not train under the influence of drugs, alcohol, or any substance that impairs judgment.
  • WāhiBJJ reserves the right to refuse participation if staff reasonably believe it poses a risk to you or others.

10. Property & Personal Belongings

  • WāhiBJJ is not responsible for lost, stolen, or damaged personal property, including items left in changing rooms, bags, or vehicles.
  • Members are encouraged to leave valuables at home.

11. Privacy

  • WāhiBJJ may collect and store personal information for membership management, health and safety, and communication purposes.
  • Data will not be shared with third parties except as required by law or payment processing.

12. Changes to Terms

  • WāhiBJJ may amend these Terms & Conditions with one month’s notice (except where required by law).
  • Updated terms will be communicated by email/text and displayed in the gym.

13. Governing Law & Dispute Resolution

  • This agreement is governed by New Zealand law.
  • Any disputes should first be raised with WāhiBJJ management. If unresolved, both parties agree to mediation before pursuing legal action.

14. Young Members

  • Members under 18 years old must have a parent or legal guardian sign this agreement.
  • The parent/guardian accepts responsibility for:
    • The young member’s conduct,
    • Compliance with payments, and
    • Any obligations under this contract.
